Welcome to Record Shop Radio (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website located at http://www.recordshopradio.org, our mobile application (RecordShopRadio), and any related audio streams, music submission platforms, or interactive features (collectively, the “Services”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these contractual specifications, you are strictly prohibited from using our Services and must discontinue use immediately.
1. Intellectual Property Rights
Unless otherwise indicated, the Services, including all source code, databases, functionality, software, website designs, audio stream nodes, text, photographs, and graphics on the Services (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by international copyright and trademark laws. The Content and Marks are provided on the Services “AS IS” for your information and personal use only.
2. User Representations
By using the Services, you represent and warrant that: (1) all submission details or identity context you provide will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity and agree to comply with these Terms; (4) you are not a minor, or have received parental permission to browse this platform; and (5) you will not use the platform for any unauthorized or illegal activity.
3. Music Submissions and Showcase
If you submit tracks, lyrics, audio files, artist descriptions, biographical profiles, or other promotional materials (collectively, “Submissions”) to our New Artist Showcase or via any contact forms:
• You warrant that you own or control all necessary performance rights, broadcasting rights, and licenses for the music.
• You grant Record Shop Radio a non-exclusive, worldwide, royalty-free, perpetual license to stream, play, host, and feature your Submission on our digital audio streams and web applications for promotional purposes.
• We reserve the absolute right to screen, refuse, remove, or permanently delete any Submission at our sole discretion, without notice and without liability.
4. Prohibited Activities
You may not access or use the Services for any purpose other than that for which we make them available. Prohibited activities include systematically retrieving data to compile directory files, attempting to circumvent security features, unauthorized framing, or exploiting our streaming node data for external commercial profit without prior written authorization.
5. Third-Party Widgets and Links
Our web ecosystem features external components, including an interactive streaming audio widget hosted on third-party servers (such as Citrus3). We do not investigate, monitor, control, or endorse these third-party environments and cannot be held responsible for their availability, operational safety, or data tracking parameters. You acknowledge that reliance on embedded widgets is done entirely at your own risk.
6. Service Interruptions and Maintenance
We cannot guarantee the digital station will be available 100% of the time. We may experience hardware, software, or network issues resulting in stream delays, dropouts, or errors. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or stream our Services during station downtime.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES AND OUR AUDIOPLAYER WIDGET WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE PLATFORM AND YOUR USE THEREOF.
8. Limitation of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA ARISING FROM YOUR USE OF THIS PLATFORM.
9. Governing Law
These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of New Jersey and the United States, without regard to conflict of law principles.
